How are food service workers supposed to strike? All that product will go bad due to their inaction, that sounds a lot like this sabotage. Before you point out that restaurants are rarely unionized, consider the Vietnam veteran brothers who fought the best america had shirt moreover I will buy this grocery warehouse workers and truckers. They often are. This would be like the food service workers took all the food out of the freezer and cooler and dumped it on the floor on the way out. In this specific case the concrete truck drivers bailed mid job and let the concrete start to setup in the trucks before returning to the yard. They also never told any non-striking workers that they were walking off and that the trucks were full. So, there was very clearly a deviation from the standard strike behavior here The kicker is that Thomas and Gorsuch didn’t think the decision went far enough, so their opinions told the companies in so many words to come back and try again. The strike itself wasn’t what was being declared sabotage/destruction of property; it’s that the workers left wet cement in trucks and then leave it to dry inside the trucks. Actual, tangible destruction. Not hypothetical lost profits. They causes tangible losses because products have already been bought and aren’t being sold but all future profit is hypothetical until it’s actually in your hands.

Still not the Vietnam veteran brothers who fought the best america had shirt moreover I will buy this same as actual destruction of physical property. That’s why this case made it to the Supreme Court and if you’re missing that, you’re the one who’s dense. In this particular case workers filled trucks with liquid cement knowing they would be striking and that the cement would harden. This caused damage to company equipment. The company wants the right to sue the union over the cost of those trucks, which were pretty blatantly sabotaged. It’s one thing to strike. I’ve picketer before when I worked in the telecoms field. It was one thing to walk out – it would have been entirely over the line if I had cut the lines on my way out. When it’s laid out like that, it’s not that bad of a ruling. It’s basic level accountability. Usually it’s good when people’s feet are held to the fire. And again, it’s a very narrow ruling. You can sue a union if they sabotage equipment. That won’t apply to most cases.
