Either the Summer state of mind shirt and by the same token and owners are quite literally the dumbest people that have ever done business in this country, or they’re just bluffing. While I don’t disagree with the suggestion of joining a union, no union in the country can represent you retrospectively. It’s against the law to represent someone in a legal sphere as a union representative if the incident happened prior to the employee joining the union. Kind of like buying car insurance the day after you wrapped it round a lamp post…. Ignore EVERYTHING THEY SAY and file a wage complaint. You have several. Get all your co-workers to do the same. Citizens make complaints, and the police and related authorities decide if there is a charge to be filed. This is all bogus, do not allow them to swindle you out of wages and tips that you are legally entitled to.

I would question their ability to review CCTV footage and determine when people are and aren’t paying for drinks. Did they keep a tally of every shot poured that they thought they didn’t see someone pay for and calculate that? You’ve had some great advice including a police officer. I’m going to focus on only one element of employment law which is something called a ‘protected characteristic.’ Protected characteristics are things like sex or race meaning employers are not allowed to discriminate on grounds of sex, race etc… If you can prove discrimination in a court of law (employment tribunal) for any of these characteristics, the Summer state of mind shirt and by the same token and awards are theoretically uncapped. Bullying is not technically a protected characteristic in the same way sex discrimination is but in reality, it can be. What it means is if it can be demonstrated in court that an employer is bullying their staff, then they can be fined and financial awards can be made to the staff, even if employees are not permanent staff. Because employers have to abide by the law, irrespective of whether employees are permanent, have less than 2 years permanent employment etc… There are three elements here. Firstly, you need to collect any evidence they have written down. E.g. emails etc…. Secondly, you need to note down dates / times of any verbal bullying incidents where there are multiple witnesses. Thirdly, you need to note that you and the other members of staff tried to do something about the bullying but the processes were not in place to deal with this.
