It gets worse. If he thought they did, then he wouldn’t have simply overturned Roe––he’d have banned abortion. The majority opinion leaves it up to legislatures to determine whether the unborn have legal rights. But, of course, in saying that those rights are left to legislatures, Alito a fortiori says that they are not constitutional. Disgustingly, the editorial also tries to maneuver around the 14th Amendment and read it as qualifying the due process clause to citizens, rather than to persons. This kind of tricksy insinuation is mean, base, and unworthy of publication.

There is obviously more textual basis for gun rights than for abortion rights. Set aside whether cases like DC v. Heller were rightly decided. It is stupid to put the two claimed rights’ textual basis on equal footing and insinuate hypocrisy by the court. It is much easier to textually locate a right to gun ownership in 2A than to locate a right to an abortion in 14A. It just is. Whether or not you think that’s good or bad is immaterial. The point is that the Court is not hypocritical.
