So very few then? because only 11 states have duty to retreat, the rest either have SYG in law, or apply it as part of self defense. And even those states apply a form of castle doctrine, which this one borders on since the bus driver was at work and in a vehicle. I know you want to make this something more political, but even blue states have statutes or recognize case law regarding SYG, including CA….so you’re using the wrong talking points. Easy hot shot, not making any kind of political statement. Castle doctrine would be a stretch, since it’s almost always applied to a home or personal vehicle, and especially since it’s unclear who instigated the shooting. In my state, there is no duty to retreat, but shooting someone after they no longer present a threat would generally be considered assault or attempted murder.

Even in areas w/o SYG laws, I think most reasonable people would say they couldn’t reasonably retreat, so again SYG is pretty moot. Its not the shooting, its the reasonable fear of imminent great bodily harm or death….someone making threats to shoot you, then pulling out a gun does rise to that level. You don’t have to let someone shoot you before you’re able to legally fire in self defense. shooting someone after they no longer present a threat would generally be considered assault or attempted murder I really think you were trying to go for the low hanging fruit of “SYG states bad!!” but really, this case isn’t a SYG issue. The driver going after the guy after the initial firefight will be the issue, not whether or not he was justified to shoot at the passenger.
