Possibly – I haven’t read the Tree of Life As Above So Below As Within So Without shirt Also,I will get this opinion. I am just going off of the “destruction of property” I am hearing in the “news”. Basically what these guys did was load delivery trucks with wet cement and THEN then walk off. Deliberate and intentional destruction of property caused by the cement hardening in the trucks. They were delivering it, went on strike, returned to the depo. The company dumped the concrete, and then sued the union for the concrete. Not the trucks. The company sued the union in state court, claiming the truck drivers had endangered company equipment. Wet concrete, it explained, hardens easily, and the company had to initiate emergency maneuvers to offload the concrete before it destroyed the trucks The court ultimately said the union’s conduct in this particular case posed a serious and foreseeable risk of harm to Glacier’s trucks, and because of this intentional harm, the case should not have been dismissed by the state supreme court. Seems like the courts argument is that serious damage was just an obvious and foreseeable outcome that it was essentially intentional, making it akin to vandalism. If the trucks had been emptied prior to walking off, this wouldn’t be a case we’d be discussing and the union would still have their strike. Exactly this. That’s actually what they did…it wasn’t the strike itself that is being held liable, it’s the actions of the staff just preceding the strike in order to cause the strike to cause damage – they filled trucks with quick perishable cement and then went on strike leaving the product to perish. They’re being found wrong for deliberately sabotaging product, NOT for the actual strike.

I agree that this case has nuance and I don’t know what side I would fall on; I think it would still not be on the Tree of Life As Above So Below As Within So Without shirt Also,I will get this corporation’s side given what I’ve seen, such as no machinery actually being damaged, and this not being planned deliberate sabotage but just the natural result of when the strike started. This is all based on my understanding of the case, and I can accept some facts may be different and my view might change. The real big issue however is that this was decided by SCOTUS. The usual solution is arbitration via the NLRB, where the outcome applies to that case and that case alone – now we have judicial precedent than not only can a company sue, but they should. Precedent like this can and will be abused by employers, and will be stretched way past the possibly reasonable case this represents.
