In many jurisdictions an officer cannot arrest an individual for a misdemeanor offense unless it occurs in his presence. In this particular event the offense did not occur in his presence so he could not arrest a woman for this misdemeanor assault. If it was a felony, upon probable cause she could be arrested whether or not the officer was present. This however was/is a misdemeanor offense. For a misdemeanor not committed an the officers presence the can obtained an arrest warrant after the fact. Once he has obtained that arrest warrant then he can arrest her. Arrest warrants must be signed by a neutral magistrate and must be supported by an affidavit. These things unfortunately take time. So the statement that the officer cannot arrest her because the event did not take place in his presence is absolutely correct. Once he obtained an arrest warrant then she can be arrested which occurred her. This is the law in almost all jurisdictions.
