I haven’t read the The Also,I will get this case, don’t know the relevant laws or arguments. Honestly, I’d always thought that when you had property seized for this sort of thing, you WOULD get anything over what you owed after it was sold at auction. I just figured it was fairly rare, because people in that situation rarely are keeping up their property. Lady’s house was seized for back taxes and auctioned off. Honestly I’m glad they just kept it to “the homeowner gets to keep the difference.” It’s going to slow everything down, but I was legitimately worried the current makeup of the Supreme Court would have just ruled that it’s illegal to seize and auction off anything for back taxes. This seems like the best outcome. Because it’s used as an explanatory literary reference and not as the judicial basis for the decision. Frankly as an atheist I’d prefer it wasn’t in there, but it’s not a huge deal that it is. Other judges have put asinine references that are kinda cringe in their decisions as well. I recall a Federal District Court judge making Star Trek references all through a decision a few years ago, for example.
