The Court ruled that the right to strike is “limited by the requirement that workers take reasonable precautions to protect the employer’s plant, equipment, or products from foreseeable imminent danger due to sudden cessation of work.” Here, the employer, concrete company, alleged that its truck drivers (union workers) showed up to work, filled up their mixer trucks with concrete, and then drove off to deliver the concrete to customers. During their route, the Union called for a strike and directed the truckers to stop delivery and return to the yard. A few truck drivers did return, but others allegedly abandoned their trucks. The employer alleged that leaving concrete in the trucks’ rotating drums would not prevent the concrete from hardening indefinitely, and there was a serious risk that it could damage the trucks. In the end, the company was able to scramble to find the trucks and dump the concrete out in a safe manner and prevent damage to the trucks, although the entire batch of concrete for the day was lost. The company sued its truck drivers in state court seeking damages under state law tort claims of conversion and trespass of chattels. The state district court (and eventually the state supreme court) held that the company’s claim was preempted by the National Labor Relations Act (NLRA – federal law) because it involved a strike (meaning they couldn’t recover under state law).
