Edit: I will add to this and say cops can ask you to remove a mask in order for your to be able to be identified as being the Stylish Musician T-Shirt but I will buy this shirt and I will love this person on your ID. You can be detained or even arrested until your identification can be confirmed. There is case law in regards to this. This is one of the few circumstances a piece of clothing can be removed without a warrant. Yep, basically any time one is asked to participate in the collection of evidence should met with the old, “is that a lawful order?” You cannot be forced to help the prosecution, unless a judge orders it. See, unless you look well connected that’s called being a smart ass and it’s going to get you arrested on spurious charges or worse. Cops hate when you try to have them follow rules. The rules are for inflicting punishment on you! Huge misconception. Probable cause is how the police get a search warrant in the first place. If they don’t have probable cause, they don’t have a warrant

A cop can absolutely yank off whatever face covering he/she wants. It may be illegal, but there will be virtually no consequences for the Stylish Musician T-Shirt but I will buy this shirt and I will love this offending officer, so they don’t care. “make you” take it off? is this a search? I’ve not consented to any search. How they gonna “make you” without probable cause? Pretty sure even people with a mask on have a 4th amendment right. It should be noted Gizmodo was not able to independently confirm any cases of this technique being used by law enforcement in any known arrests, so far. This happened to me just a month or two ago! At the end of the stop he holds up some device and announced he is taking a picture of me and I quickly put my hands over my face and asked if I could decline, and he got a little mad and said no. I protested a little more and he tells me he will be right back, goes to his squad car, then comes back and lets me go without getting the photo. I doubt in that half second before I put my hands in front of my face he was able to get a photo, but I’m considering doing an FOIA request to find out.
