Hi folks, so… I cought a wife of a month cheating. We have a house together from before we were husband and wife and I want to buy her out, how do we go about this? We have declaration of trust written up, where in an event of sale I get deposit back as a percentage of the Santa’s Favorite Educator Christmas Ho Ho Shirt but I will buy this shirt and I will love this house value (10%) and then everything else is split in half. As I was the only one who had money for deposit. I personally want to give her as little as posible due to us having that house for less than 1.5 years and well she cheated and doesnt deserve anything more than what she put in towards the house. But I know that we dont life in that kind of world… She has property in our home country that she bought before we were an item, but property was bare walls. I kind of subsidised its development by paying bigger share of our household expenses and now that we are wife and husband, does any fraction of it legaly would belong to me or not?

The house was acquired pre-marriage but jointly owned so will be split equally (minutes the declaration of trust) But the fact she cheated or the fact that you paid more expenses during the marriage will not affect the division of assets. (In fact, if anything, paying more expenses during a marriage means you are more likely to continue paying additional expenses after the marriage. This is more likely in longer term relationships) Also, you need to find out if your marriage needed to be registered in UK in order to be recognised or not, which depends on what country you got married in. As for the other property, you could claim a financial interest if you can prove that you contributed to increasing its value.
