I viewed a property 2 weeks ago. After some back and forth negotiation during which the Please Don’t Yell At Me I Will Cry Shirt besides I will buy this agent basically said he won’t take lower than x I caved and offered x and had my offer accepted. I received an email saying it was being taken off the market. I received a ‘congratulations on having my offer accepted’ email and a memorandum of sale from the agents. Verbally the agents told me that they had another person booked for a 2nd viewing but they would cancel it because he had accepted my offer. Yesterday I then was told that the person who had the second viewing had offered more than me and was told even though they couldn’t view a second time they offered anyway. Then I found out from a neighbour of the property that after sending those emails on Tuesday morning the agent DID SHOW the other person around on Tuesday afternoon and that person then offered more than me.

I called the Please Don’t Yell At Me I Will Cry Shirt besides I will buy this agent out and they admitted they lied about cancelling the viewing and apologized but said they have to put forth any offer they get and now she has offered there is nothing they can do unless I up my offer. Am I correct in thinking that I’m just shit out of luck here?Sadly yes – at this stage, all you have is a theoretical assurance that the vendor would sell the house to you for a certain price. Until you actually exchange contracts, either party can lawfully change their mind. Afraid not, as you have no contract with the agent, their contract is with the seller. Professional standards maybe… oh wait, we’re talking about Estate Agents. Their necessity somehow makes them all the worse. It’s like they know you need them so they compete to see just how awful they can actually be
