Nobody including SCOTUS is saying the Micky Mouse Walt disney 100 years 1923 2023 where dreams come true shirt but I will buy this shirt and I will love this workers don’t have the right to strike. But SCOTUS is saying if you do strike you can’t do it in a way that intentionally or negligently is going to cause proximate damage to property. You can leave all the faucets running knowing they’ll flood the bathrooms, you can’t leave the gas on in the stoves knowing the place might blow up before someone shows up to turn them off, etc. In this case the company is claiming that’s essentially what the union did, they just left the trucks running with nobody there to empty them mid delivery and it cause damage to some of the trucks and lost a lot of the concrete. The union could have easily opted to have people walk out once the trucks were emptied and/or refused to fill them that morning, for instance, but instead allegedly wanted to put them in this precarious position.

Anyway, bottom line, no, this ruling doesn’t mean unions are liable simply for going on strike. It’s just reaffirming that they might be liable if they intentionally or negligently wreck stuff when they leave. The SC ruling, in no way, is determining who is responsible. It’s just saying that the Micky Mouse Walt disney 100 years 1923 2023 where dreams come true shirt but I will buy this shirt and I will love this lawsuit to determine responsibility at the state level can continue. This case isn’t to say they did something wrong, merely to say they can be sued. The union could win the lawsuit. The union could also probably sue on similar reasoning for damage. Ex-fucking-cuse me? I don’t have to go to any job I don’t want to go to at any point I don’t want to for any reason I don’t want to. The consequences are my own, but I am not their property. Did the Supreme Court just officially call us all slaves?
