A trustee has to sign off showing that the employee (or ex employee) is an eligible beneficiary and/or what percentage vested they are. It is not unusual to have board members as a trustee, particularly a board treasurer. It is unusual to have to have the board vote on it though. Have her do a consult with a lawyer. Maybe even just paying for a formal letter to be written from a law office will get them to cooperate. She needs to contact the third party who has the 401k and have them roll it into an IRA. If she cashes out the 401k she will be liable for taxes on it when she goes to do her taxes next year it will be very unpleasant. She needs to contact the investment company and deal with them.

Not the company you worked for. A plan administrator has a duty to insure your money is protected, and if you can’t get your money you can attack there license to manage EVERY plan for every company. I worked for a major benefits admin outsourcing company for many years, and that’s the #1 thing that held up 401(k) payouts….somewhere in the management chain, someone didn’t confirm the separation. Do you have any more details on what document the employer needs to sign? And how big was the former employer? My experience was mostly mid-size to large (2500+ employees) companies, and I’ve heard horror stories about how smaller companies (mostly 100 or fewer employees) sometimes got ‘loosey-goosey’ withe their 401(k) assets.
