I’m trying to think of a good resolution to this case and I’m stumped. It would be bad if the GOBBLEDY GOOKER professional wrestling turkey mascot T-Shirt but I will buy this shirt and I will love this affected couples had no recourse, considering the material costs and personal difficulty of having eggs extracted for in vitro fertilization. But using a civil property damage tort could be setting some kind of legal precedent that embryos are property with a specific monetary value. Maybe the hospital should be forced to cover the costs of further in vitro fertilization for the couples? But what it one or more of the affected people are sterile now, and have lost their only chance to have kids over this? Yeah it sets a bad precident but honestly if that patient wasn’t a child then they’re a colossal fucking moron that needs to pay restitution.

I think it’s because of intent. I mean yeah a fetus isn’t a child but a pregnant person will obviously consider it a child because they intend to bring it to term. So I can absolutely see deciding frozen embryos are legally considered children since the GOBBLEDY GOOKER professional wrestling turkey mascot T-Shirt but I will buy this shirt and I will love this intent was for them to be brought to term. Same reason you can get charged with double homicide for murdering a pregnant person. Ok, but logically, you could argue that they are humans and deserve human rights. How is this illogical? The “Freedom” to choose to murder your child is evil and a self-serving excuse. Why should your “Freedom” trump the right to life of another human? I don’t see how this is illogical or anti-freedom. If I understand this properly, this isn’t like the abortion issue where a person’s bodily autonomy is on the line. Frozen embryos are, in fact, living beings and clearly distinct from another being. All living things have a right to life, with the “strength” of that right being determined by the level of “sapience” (maybe not the exact word for this concept). So things like fetuses and parasites don’t have the strength of a right to life to overcome the right to bodily autonomy that a more developed person has.
