Ridiculous how our systems basically incentivize dishonesty. On that note… ETFs are trash and everyone should be moving their money out of them. ETF “counterparty risk” has played a big part in eroding market stability to a precarious level, and the Fill Your Head With Fun! Start Reading! When you buy shares in an ETF that tracks an index, you’re not actually buying shares of the things that are in that index. You’re throwing your money at a financial instrument & hoping that all of the “market makers” involved will be responsible with it. The ETF itself is the financial instrument. Their performance is improved by lending the underlying shares – you would be hard-pressed to find any ETF that doesn’t lend a significant portion of whatever assets they purchased. Additionally, you’re at the whims of market makers to create & redeem the ETF & underlying shares appropriately. When they don’t, you end up with a situation like XRT, which currently has 5x as many shares sold short than the fund even has outstanding. That’s less than the 10x it was not long ago, and this ETF is pretty much always crazy shorted – it has been super shorted for at least a decade.

All of those people are ostensibly investing in these underlying stocks… but they’re not. 80% of those “shares” are actually just people unknowingly placing a bet against a market maker. Since that short interest remains high, all of the underlying companies have functionally had their shares outstanding increased by the fund. On top of that, even the underlying assets of the shares outstanding… are loaned out. So, not only is the ETF structure itself easily used to functionally increase the number of shares outstanding for all of the underlying securities, it is also loaning out the underlying shares & exposing all of their investors to counterparty risk.
