Rights that only exist because of court precedent are shaky. Regulation is weak. Legislation is better. Amendments are best. Edit 2: I strongly suggest regardless of your gut reaction to read the leaked draft here I’m kind of a political/judicial novice here but has there ever been a major social issue that has been ruled on by SCOTUS that they later ruled differently on? I’m thinking of the Dredd Scott case but that was overturned by a presidential proclamation.

Wade ruling was basically permanent and that the Court couldn’t decide later they were wrong and change their mind on it. It definitely happens. Precedent only sticks if the Court doesn’t have the numbers and inclination to change it. Dredd Scott vs Sanford was only overturned by presidential proclamation in those parts of the United States that were in active revolt against the federal government. Lincoln was able to justify it by the war powers inherent to the executive branch, but it wasn’t really tested in the courts. Dred Scott was still law in those slaveholding states that didn’t secede (Maryland, Kentucky, etc). It didn’t get overturned in those places until the 13th Amendment was ratified after the war. Plessy v. Ferguson held segregation was fine, separate but equal. Brown v. Board reversed that. Again, nothing in the constitution explicitly says schools can’t make brown kids go to different schools than white kids.
