If you go to small claims court they will not help you collect the debt but they will issue a judgement which you can then take to the executor and become an creditor just as above. I’m not a lawyer but I have had experience with transactions pending while people have died. If I were you I would bring all the evidence to his family or heirs after an appropriate period of time (whatever that is)and just appeal to their human nature . Assuming their loved one was an honest person, hopefully they are too and would honor his memory accordingly. Hard lesson to learn man, always pay upfront when you are getting product. I’d never pay in advance for something, I always see whatever I’m buying then buy it right then and there if I want it.

This is certainly a bizarre, difficult situation! I’m not a lawyer though honestly, I believe it would cost you more than $3000 to get back your deposit. Maybe the napkin receipt might work, though I doubt it would save you from spending the money on lawyers. It might be beneficial to spend 200 or 300 dollars getting an estate lawyer’s opinion if you have a case in recouping your money and about how much it would cost to take it to court. Though If I were you, I would probably just walk away chuck it up to life happens and just move on. The family will likely be willing to honor the sale, if they aren’t attached to the car.
