Democrats had 50 years to codify Roe v Wade into federal law, and instead chose to play political football with it for votes. Rights shouldn’t have to be codified… they are rights. And up until now, even Republicans justices have respected precedence. This decision, if it overturns Roe vs. Wade, would be one of the Bernie sanders hugging ca cute animal lover president election shirt and I love this most un-American decisions ever, right there with giving corporations the same rights as citizens. If you think that’s a good reason to let the guys putting judges who are making these kinds of decisions put in even more judges, faster, then you might want to rethink that. Except that if the supreme court rules the law is unconstitutional, then that federal law would be tossed as well.

That’s not how federal policy works. Congress doesn’t need a specific “right” to impose federal policy, it’s only when the Bernie sanders hugging ca cute animal lover president election shirt and I love this judiciary specifies an authority as unconstitutional that they can be prohibited from such. SCOTUS isn’t ruling a law unconstitutional, it’s (potentially) overturning its own prior ruling/justification. Basically, “our prior argument to prevent a particlar law (and truly set a legal structure well beyond that scope) wasn’t valid”. You’ve read it else where because most people are idiots, fear mongering, or purposely providing misinformation as to promote their own agenda of state controlled laws. You have Democrat politicians promoting enshrining Roe v Wade in the federal legislature. But some as well don’t believe such is possible right now and thus argue false rhetoric as to demand more outrage to potentially prevent the overturn as to not have to resort to a process that may be haulted. People aren’t focusing on a federal imposed law, not because it would be unconstitutional, but that both sides view it as infeasible given the current partisan makeup and views on this issue. The whole reasoning behind Roe being overturned is precisely because there was no legislation passed through democratic institutions on the matter. The draft explicitly says that it is up to elected representatives and voters to decide, not a top down decision from the court.
