This gave the enforcement officers a convenient way to evade responsibility, because now they can ask the child “do you wanna continue to live with mom, or do you want to go live with dad?” And if they say they don’t want to go, they dismiss the attempt, and just write a report that they couldn’t enforce. This guideline is outdated because they didn’t expect parents would both like to have the child. Even experts in Korea and the Korean goveent agreed to change it, so did the supreme court. There are some countries where the father’s rights are absolute and they can obtain court orders to keep the children regardless of their fitness as a parent. So if the child has a reason to fear or not want to return they should have a say. But I can’t honestly say Korea is failing here, and I don’t agree this clause or ruling is giving them an easy way to avoid enforcing an order. It’s is very important to know that court already decided (1) What is the child’s opinion or (2) should we consider the child’s opinion.
